Terms of Service
These Terms of Service govern your access to and use of the websites, software-as-a-service products, research tools, digital publications and related services provided by KMS Research and Innovation Lab LLC ("KMS", "we", "us" or "our"). By using a KMS service or purchasing a subscription, you agree to these Terms.
1. Eligibility and accounts
You must be legally capable of entering into a binding agreement in your jurisdiction. You are responsible for information submitted through the service, for keeping access credentials secure, and for activity that occurs through your account or browser session.
2. SaaS subscriptions and billing
Paid plans are billed in advance at the price and billing interval shown at checkout. HumanWork Proof may be offered as a free diagnostic and as Premium subscriptions, including monthly and annual plans. Subscription payments are processed by Stripe. KMS does not store full payment-card numbers. Unless otherwise stated, subscriptions renew automatically until canceled.
You may cancel a recurring subscription before the next renewal date. Cancellation stops future renewals and does not, by itself, create a refund for the current paid period. Any refund request is governed by our Refund Policy and applicable law.
3. HumanWork Proof scope
HumanWork Proof provides descriptive, normalized textual indicators intended for low-stakes self-assessment and document review. It is not an AI detector, an authorship detector, proof of misconduct, proof of fraud, or a substitute for contextual evidence and qualified human judgment. A score is not a percentage of human authorship or a probability that AI was or was not used.
HumanWork Proof must not be used as the sole or automatic basis for employment screening, hiring, academic grading or admission, disciplinary action, fraud findings, legal determinations, or other high-stakes decisions.
4. Acceptable use
You agree not to use KMS services to:
- violate law, regulation, intellectual-property rights, privacy rights, or contractual obligations;
- upload content you are not authorized to process;
- circumvent access controls, subscription gates, security measures, rate limits or product restrictions;
- reverse engineer, disrupt, overload, scrape, or misuse the service except where applicable law expressly permits it;
- misrepresent KMS outputs as certification, forensic evidence, or an official determination when they are not.
5. User content and document processing
You retain your rights in content you submit. You grant KMS the limited permission necessary to process that content to provide the requested service. Where HumanWork Proof file upload is used, the file may be sent to a KMS extraction service solely to extract usable text; the source file is not intended to be persistently stored by that extraction flow. 6. KMS intellectual property
KMS owns or licenses the software, interfaces, methodologies, trademarks, branding, documentation and other proprietary materials used to provide the services. Your subscription grants a limited, non-exclusive, non-transferable right to use the service during the applicable access period; it does not transfer ownership of KMS intellectual property.
7. Service changes and availability
We may improve, modify, suspend or discontinue features when reasonably necessary for security, reliability, legal compliance, research integrity or product evolution. We do not guarantee uninterrupted availability. Where a paid service experiences a material KMS-caused failure, you may contact us for review under the Refund Policy.
8. Disclaimers
KMS services are provided on an "as is" and "as available" basis to the extent permitted by law. Outputs may contain limitations, uncertainty or errors and must be interpreted in context. KMS does not provide legal, medical, investment, employment, admissions, forensic or other regulated professional advice through HumanWork Proof.
9. Limitation of liability
To the maximum extent permitted by applicable law, KMS will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunity arising from use of the services. Where liability cannot lawfully be excluded, KMS's aggregate liability relating to a paid service will not exceed the amount you paid to KMS for that service during the twelve months preceding the event giving rise to the claim, except where applicable law requires otherwise.
10. Suspension and termination
We may suspend or terminate access for material breach, fraud, abuse, security risk, unlawful use or nonpayment. You may stop using free services at any time and may cancel paid subscriptions through the available billing flow.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except to the extent mandatory consumer law in your jurisdiction applies.
12. Changes to these Terms
We may update these Terms as our services evolve. The current version and its effective date will remain published on this page. Material changes affecting paid subscriptions will be communicated when reasonably required.
